These Terms & Conditions govern the purchase of products through the EMR Storage Solutions website and form part of the contract between you and EMR Storage Solutions Limited.
By placing an order through our website, you confirm that you have read and understood these Terms & Conditions.
These Terms & Conditions apply to purchases made by consumers and businesses.
Where you are a consumer, nothing in these Terms & Conditions is intended to exclude, restrict or otherwise limit any statutory rights or remedies available to you under applicable Irish consumer law.

EMR Storage Solutions Limited is referred to in these Terms & Conditions as “EMR”, “we”, “us” or “our”.
The customer is referred to as “you” or “your”.
3. Products and Product Information
We take reasonable care to ensure that product descriptions, photographs, dimensions, specifications and other information displayed on our website are accurate and up to date.
Product photographs are provided for illustration. Depending on the product, there may be minor differences in colour, finish, configuration or appearance between an image displayed on the website and the product supplied.
Where technical specifications are provided, customers should review them carefully before ordering.
If you require clarification about a product’s dimensions, specification, compatibility or intended application, you should contact us before placing your order.
Nothing in these Terms & Conditions limits your statutory rights concerning goods that do not conform to the contract.
4. Product Availability
All products are subject to availability.
Displaying a product on our website does not guarantee that the product will remain available until your order has been accepted.
If a product becomes unavailable after an order has been placed but before the contract has been accepted, we will inform you as soon as reasonably possible.
If we have already received payment for an order that we are unable to fulfil, we will refund the amount paid for the affected order.
5. Prices and VAT
All prices displayed on our website are in Euro (€).
Prices displayed on the website include VAT.
Delivery charges are additional unless the relevant product or order expressly states that delivery is included.
Delivery charges start from €169.
The final delivery charge may vary depending on factors including:
- the product ordered;
- product size and type;
- order quantity;
- delivery location;
- site access;
- unloading requirements;
- and other specific delivery requirements.
The applicable delivery charge will be displayed or communicated before the order is completed.
We take reasonable care to ensure that prices are accurate. If we identify an obvious pricing or product information error before accepting an order, we will contact you and give you the option to proceed at the correct price or cancel the order.
6. Payment
Bank Transfer Only
EMR accepts payment by bank transfer only.
When you place an order, the payment instructions and the bank account details required to complete the payment will be provided to you through the applicable order confirmation, invoice or payment instructions issued by EMR.
You should include your order number or payment reference when making the bank transfer.
Your order will not normally enter processing until the required payment has been received and verified by EMR.
We do not dispatch products before payment has been received in full unless an alternative arrangement has been expressly agreed with EMR in writing.
If payment is not received within the period specified in the order or invoice, EMR may contact you to arrange payment or cancel the order where appropriate.
Any refund due to a consumer will be handled in accordance with applicable law and the relevant provisions of our Returns & Refunds Policy.
7. Order Placement and Contract Formation
When you submit an order through our website, you are making an offer to purchase the selected products.
An automated order acknowledgement confirms that we have received your order. It does not necessarily mean that EMR has accepted the order or that a contract has been formed.
A contract is formed when EMR accepts your order and confirms that the products will be supplied.
We may decline or cancel an order where reasonably necessary, including where:
- the product is unavailable;
- there is an obvious pricing or product description error;
- we are unable to deliver to the specified location;
- payment cannot be confirmed;
- the order contains inaccurate or incomplete information;
- or we reasonably suspect fraudulent or unlawful activity.
If we cancel an order after receiving payment, we will refund the amount paid for the cancelled order.
8. Order Processing
Our standard order processing time is:

Orders received after 14:00 will be treated as received on the next applicable working day for standard processing purposes.
Orders placed on Saturdays, Sundays or public holidays will begin processing on the next applicable working day.
Order processing includes confirmation of the order, preparation of the products and arrangement of the appropriate delivery service.
Large, multiple or special orders may require additional preparation time. Where a different timeframe applies, EMR will communicate the applicable timeframe to the customer.
9. Delivery
We deliver throughout the Republic of Ireland.
Our standard transit and delivery timeframe is:

Based on our standard order processing and transit times, the estimated total delivery timeframe is:
4–10 working days
The 4–10 working day timeframe is an estimated delivery period and not a guaranteed delivery date, unless a specific delivery date or period has been expressly agreed with you.
Actual delivery times may be affected by product availability, order quantity, delivery location, site access, transport arrangements and circumstances outside our reasonable control.
For large, multiple or special orders, a specific delivery timeframe may be communicated separately.
Where no different timeframe has been agreed, applicable statutory delivery rights continue to apply.
10. Delivery Charges
Delivery charges start from €169.
The final delivery charge may vary according to the product, order quantity, delivery address, access conditions, unloading requirements and other delivery-related factors.
The applicable delivery charge will be communicated to you before you complete your purchase.
We will not knowingly impose an additional delivery charge that was not disclosed or agreed where the charge relates to requirements known to us at the time of ordering.
Where additional delivery costs arise from circumstances specific to the delivery site that were not disclosed in advance, we will communicate the situation to you before the additional cost is incurred where reasonably possible.
11. Container Delivery and Unloading
Container deliveries include:
On-site unloading
The customer is responsible for ensuring that the delivery location is reasonably accessible and suitable for the delivery vehicle and unloading operation.
Before delivery, you should consider:
- road and entrance access;
- available space for the delivery vehicle;
- overhead clearance;
- ground conditions;
- gates and access restrictions;
- nearby buildings, walls, trees or other obstacles;
- and the intended position of the container.
You must inform EMR before delivery of any known circumstances that may affect safe delivery or unloading.
If the delivery vehicle cannot safely access the site or unloading cannot reasonably be completed because the site is unsuitable or information has not been disclosed, the delivery may need to be rearranged.
12. Scaffolding Delivery
Scaffolding products and components are delivered to the delivery address provided by the customer.
Delivery arrangements may vary depending on the size, weight and quantity of the order.
Where delivery and unloading are included in the applicable order, the goods will be delivered to a suitable and reasonably accessible location at the delivery address.
Delivery does not include installation, assembly or erection of scaffolding unless this has been expressly agreed with EMR in writing.
13. Delivery Site Requirements
The customer is responsible for providing accurate delivery information and informing EMR of any known access or site restrictions.
These may include:
- narrow roads or entrances;
- restricted access;
- low bridges;
- overhead obstructions;
- weight restrictions;
- steep or unsuitable roads;
- restricted delivery hours;
- difficult or unsuitable ground conditions;
- construction-site restrictions;
- or other circumstances that may affect safe delivery.
EMR may postpone a delivery where proceeding would create an unreasonable or unsafe situation.
14. Delivery to Construction and Commercial Sites
Where an order is delivered to a construction site, commercial premises or another operational location, the customer is responsible for ensuring that the site is ready to receive the delivery.
The customer should ensure that:
- suitable access is available;
- any necessary site permissions have been obtained;
- the unloading area is suitable;
- authorised personnel are available where required;
- and relevant site-specific requirements have been communicated to EMR.
15. Inspection on Delivery
Customers should inspect the products as soon as reasonably practicable after delivery.
If visible damage, missing goods or an apparent discrepancy is identified at delivery, customers should notify EMR as soon as possible.
Where appropriate, customers should provide photographs showing the condition of the goods at delivery.
Customers should provide:
- the order number;
- details of the issue;
- photographs where relevant;
- and any other information reasonably required to investigate the matter.
This inspection procedure does not restrict or remove statutory rights concerning faulty, damaged or non-conforming goods.
16. Risk and Ownership
For consumer purchases, risk in the goods passes to the consumer when the consumer, or a person nominated by the consumer, acquires physical possession of the goods, subject to applicable law.
For business purchases, risk and ownership will pass in accordance with the applicable contract and applicable law.
Unless otherwise agreed in writing, ownership of the goods passes to the customer once EMR has received payment in full for the relevant goods.
Nothing in this section affects any statutory rights applicable to consumers.
17. Cancellation of Online Consumer Orders
If you are a consumer and purchase goods online, you generally have a statutory right to cancel your contract without giving a reason.
The cancellation period for most online purchases of goods is:
14 days from the day on which you acquire physical possession of the goods.
You must inform EMR of your decision to cancel within that 14-day period.
After notifying EMR of your cancellation, you generally have a further:
14 days to return the goods.
You may exercise your cancellation right by sending an unequivocal written statement of your decision to cancel, for example by email.

The statutory cancellation right is subject to legal exceptions.
18. Exceptions to the Statutory Cancellation Right
The statutory cancellation right does not apply in certain circumstances provided by law.
This may include, for example, goods that are:
- made to the consumer’s specifications;
- clearly personalised;
- or otherwise subject to a statutory exception.
The fact that a product is large, heavy or difficult to transport does not by itself remove the statutory cancellation right.
Where a statutory exception applies to a particular product, EMR will communicate the relevant information before the consumer is bound by the contract where required.
19. Returning Goods Following Cancellation
Where a consumer validly exercises the statutory cancellation right, the consumer must return or hand over the goods without undue delay and no later than 14 days after informing EMR of the cancellation.
The consumer must take reasonable care of the goods before returning them.
Where permitted by law, the consumer may be responsible for the direct cost of returning goods following cancellation.
For goods that cannot normally be returned by post because of their nature or size, the applicable return arrangements and costs will be communicated in accordance with applicable Irish law.
Nothing in these Terms & Conditions requires a consumer to bear a return cost that EMR is legally required to bear.
20. Refunds Following Consumer Cancellation
Where a consumer validly cancels an online sales contract under the statutory cancellation provisions, EMR will reimburse the payments received in accordance with applicable law.
The refund will generally include the cost of the standard delivery option paid by the consumer.
If the consumer selected a more expensive delivery option than the least expensive standard delivery option offered by EMR, EMR is not required to reimburse the additional cost of that premium delivery option.
Refunds will be made without undue delay and within the statutory timeframe.
For a cancelled sales contract, EMR may withhold the refund until:
- the goods have been returned; or
- the consumer has provided evidence that the goods have been sent back,
whichever occurs first.
Refunds will normally be made using the same means of payment used for the original transaction, unless the consumer expressly agrees otherwise.
21. Faulty, Damaged or Non-Conforming Goods
The statutory cancellation right described above is separate from the consumer’s legal rights where goods are faulty, damaged or do not conform to the contract.
If a product is faulty or otherwise does not conform to the contract, the consumer may have rights to:
- repair;
- replacement;
- price reduction;
- termination of the contract and refund;
- or another remedy provided by applicable law.
Where a fault or non-conformity is identified within 30 days of receiving the goods, Irish consumer law provides a short-term right to terminate the sales contract in qualifying circumstances and seek a full refund.
After the first 30 days, further statutory remedies may apply, including repair, replacement, price reduction or termination and refund depending on the circumstances.
EMR will handle qualifying product issues in accordance with applicable Irish consumer law.
22. Delivery Damage and Consumer Rights
If goods are damaged before the consumer takes physical possession of them, the consumer should contact EMR as soon as possible.
The consumer’s statutory rights are not dependent on accepting a damaged product or accepting a repair where the law provides a different remedy.
Nothing in these Terms & Conditions transfers responsibility for delivery damage to the consumer where applicable law places that responsibility on EMR.
23. Delayed or Non-Delivery
EMR will make reasonable efforts to meet the estimated delivery timeframe stated in these Terms & Conditions or the specific timeframe agreed for the order.
Where goods are not delivered within the agreed timeframe, applicable statutory rights apply.
Where no specific delivery period has been agreed, Irish consumer law generally requires delivery without undue delay and, unless otherwise agreed, no later than 30 days after conclusion of the contract.
Where the applicable legal conditions for termination due to non-delivery are met, the consumer may be entitled to terminate the contract and receive a refund.
24. Business Customers
These Terms & Conditions apply to both consumers and business customers.
A consumer is an individual acting for purposes outside that person’s business, trade, craft or profession, as defined by applicable law.
Consumer-specific statutory rights, including statutory cancellation rights for distance contracts, apply only where the customer qualifies as a consumer.
Business customers should ensure that all company, billing and delivery information supplied to EMR is accurate.
For large, commercial or specially configured orders, EMR may agree additional written terms with the business customer.
25. Product Use and Safety
Customers are responsible for using products appropriately and for their intended purpose.
Scaffolding products must be selected, assembled, used, inspected and maintained in accordance with applicable instructions, technical information, safety requirements and professional standards.
Where manufacturer instructions or technical documentation are supplied, customers should read and follow them before using the products.
EMR does not provide structural engineering, site design, construction design or professional installation advice unless expressly agreed in writing.
Customers should obtain appropriate professional advice where the intended use requires structural assessment, design, installation expertise or other specialist advice.
26. Product Suitability
Customers are responsible for considering whether a product is suitable for their intended application.
If you are unsure about the suitability, dimensions, configuration or technical characteristics of a product, please contact EMR before placing the order.
Information provided by EMR about a product should not be treated as professional structural, engineering or construction advice unless expressly provided as such by a suitably qualified professional under a separate written agreement.
27. Website Content and Errors
We make reasonable efforts to ensure that website information is accurate and current.
However, occasional typographical, technical or other errors may occur.
We reserve the right to correct errors and update product information.
Where an error materially affects an order, we will contact the customer and provide an appropriate solution in accordance with applicable law.
28. Intellectual Property
Unless otherwise stated, all content on this website, including text, graphics, logos, photographs, layouts and other materials, is owned by or licensed to EMR Storage Solutions Limited.
You may not reproduce, modify, distribute or commercially exploit website content without our prior written permission, except where permitted by law.
29. Limitation of Liability
Nothing in these Terms & Conditions excludes or limits liability that cannot legally be excluded or limited.
Nothing in these Terms & Conditions restricts or removes any statutory consumer rights.
Subject to the above, EMR will not be responsible for losses that are not reasonably foreseeable or that arise from circumstances outside our reasonable control, to the extent permitted by law.
EMR will not be responsible for losses arising solely from the customer’s misuse of products, failure to follow applicable instructions, unauthorised modification of products or use of products for an unsuitable purpose, subject to applicable law.
30. Events Outside Our Reasonable Control
EMR will not be responsible for delays or failures caused by circumstances beyond our reasonable control, including severe weather, road restrictions, transport disruption, industrial action, natural events, government measures, supplier disruption, shortages or other circumstances that could not reasonably have been prevented.
Where such circumstances materially affect an order, we will take reasonable steps to inform the customer and, where possible, arrange an alternative delivery timeframe.
This provision does not remove any statutory rights available to consumers.

34. Governing Law
These Terms & Conditions are governed by the laws of Ireland.
Where you are a consumer, you retain the benefit of any mandatory consumer protections that apply to you.
Nothing in these Terms & Conditions prevents a consumer from exercising a statutory right or remedy.
